Terms of Service and Liability Waiver

 

Code of Conduct

At Aotearoa Youth Aerial Championship (AYAC) our code of conduct is simple and applies to all competitors, coaches, guardians, patrons, parents, volunteers and staff. Disrespectful, exclusionary, hateful, or discriminatory behaviour will not be tolerated in our competition by any person towards another. Anyone displaying such behaviour through their words or actions will be asked to leave without a refund or other compensation for uncompleted services. Disruptive or unsafe behaviour may also result in warnings, being asked to sit out or leave the competition without refund.

Rules of Conduct

1. All safety instructions from the organisers must be followed.

2. Only appointed people are to handle rigging and tie offs.

3. Swinging on the equipment/apparatus is prohibited. Unsafe and inappropriate use of equipment and conduct will be cause for removal from the center.

4. Communication is a must. If you feel at risk or uncomfortable during an activity or see other participants in unsafe situations you must notify organisers immediately.

5. Do not make contact (hands, feet, body...) with rigging or walls/support structures of the facility.

6. Equipment/apparatus brought in from outside AYACs provided competition gear must be inspected for compatibility with onsite rigging by the organisers prior to use.

7. All non-participants, unless pre-approved, must stay outside of the stage floor area.

8. Entry to the competition and venue is at the discretion of the organizers, a paid for ticket does not reserve the right to enter. Organizers may ask anyone to leave at any time without reason irregardless of having a paid for ticket, if asked to leave you will not received a refund for your ticket/s.

8. All tickets and fees are non-refundable.

9. AYAC reserves the right to enforce all rules and regulations. Any failure to comply with the rules and regulations may result in disqualification from this event as well as future AYAC events.

Attire

Wear appropriate clothing (no buckles, belts or buttons, no loose clothing, no shorts), have hair tied up/tidy and bring water backstage during the competition. No jewellery (except ear studs). 

Cancellation Policy

Competition Fees and tickets are non-refundable.

Mobile Devices and Photography

1. Please switch off your mobile phones and devices during the performances. If you have to take/make a call or text during class, please wait for a performance to finish and go outside. 

2. Social Media etiquette: We encourage you to share photographs of yourself or the competitors  taken during the event on social media.

3. Please tag the AYAC social media accounts, if possible.

4. If there are other people in your photograph, even if they consented to being photographed, please do not tag them without their permission. 

Privacy Policy

AYAC is sensitive to privacy issues on the Internet. We believe it is important you know how we treat the information we receive on the Internet about you. 

Gathering Information

The personal information we collect is used only by us to respond to your inquiry. This increases our level of customer service and allows us to provide the information you requested in an efficient manner. No other organization other than AYAC, Aerial 3 and Aerial Silks Ltd will receive information about you.

The AYAC website may contain links to other sites. While we try to link only to sites that share our high standards and respect for privacy, AYAC is not responsible for the content or the privacy practices employed by other sites. 

Cookies

A cookie is a tiny element of data that a Web site can send to your browser, which may then be stored on your hard drive for future recognition. You may set your browser to notify you when you receive a cookie. At this time the AYAC site does not employ the use of cookies. 

Copyright Policy

The contents of the AYAC website are protected by applicable copyright laws. No permission is granted to copy, distribute, modify, post, or frame any text, graphics, video, audio, software code or user interface design or logos. Unauthorized use or exploitation of such marks and names is strictly prohibited. Unauthorized downloading, re-transmission, storage in any medium, copying, redistribution, reproduction, or republication for any purpose is strictly prohibited. 

Internet E-mail

E-mail over the Internet is not a secure medium and privacy cannot be assured. AYAC cannot assume any responsibility for any harm or damage you may experience or incur by sending personal or confidential information over the Internet by E-mail, or if we send such information at your request. 

Disclaimer of Liability

1. AYAC is not responsible in any way for any damages (direct, indirect, special, economic, or consequential) in respect of use of this Web site, any of its content or any Web browser. 

2. AYAC is not liable for any loss, injury, or damage incurred by a competitor or performer during any stage of the competition, showcase or event.

3. AYAC reserves the right to change the General Policies at any time and will post an updated version of this policy on our website www.ayac.co.nz

Waiver and Release of Liability:

I, the undersigned participant, parent or guardian or coach, hereby acknowledge that there are inherent risks involved in participating in activities at the Aotearoa Youth Aerial Championship (AYAC).

I understand that circus sports and aerial sports involve risks that may cause various injuries and that such injuries may result in death or serious disability and may be outcomes of but are not limited to equipment failure or any instructed activity.

I also understand that circus and aerial sports are physically demanding and may cause panic or aggravation of any pre-existing medical conditions.

I recognize and understand the above mentioned risks and release AYAC and the staff/instructors/organising committee, partners and volunteers thereof from any liability that may arise.

I agree to disclose any physical limitations, ailments, or impairments which may affect my or my child's ability to safely participate and understand that disclosure does not mitigate risk or personal liability.

I acknowledge that AYAC and the organisation committee and all parties involved have taken appropriate steps to make the event a safe and enjoyable environment for all its participants and will not hold them accountable, responsible or liable should any accidents or misfortune arise.

I give my permission for AYAC to use any photographs of myself or my child for promotional purposes without limitation.

I am aware that this waiver is ongoing and will apply to all future occasions I or my child participate in circus sports and any other activities with AYAC.

I agree to indemnify, defend and hold harmless AYAC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees and any other parties involved with AYAC, harmless from any claim or demand, including attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
